Contest period

Pacific Blue Cross (the “Sponsor”) Guaranteed Acceptance Contest 2023 (the “Contest”) is an online-only contest beginning on March 6, 2023 at 12:00AM Pacific Time (“PT”) and ends on April 30, 2023 at 11:59PM PT (the “Contest period”).

Eligibility

The Contest is open to all permanent residents of Canada residing in British Columbia who meet the following conditions:

• Are 19 years of age or older
• Have a valid email account/address
• Have submitted a contest entry within the Contest Period

The contest is not open to:

Employees of D.A. Townley and Pacific Blue Cross and PacBlue Life Services Ltd. and their immediate family members; directors for Pacific Blue Cross and PacBlue Life Services Ltd.; consultants who work with Pacific Blue Cross and PacBlue Life Services Ltd.; employees of advertising and promotional agencies affiliated with Pacific Blue Cross and PacBlue Life Services Ltd. In these Contest Rules, "immediate family" means spouse, parents, and children whether or not they reside in the same household.

How to enter

NO PURCHASE REQUIRED. To enter for a chance to win, complete the following steps during the Contest Period:

1. Visit the contest page during the Contest Period
2. Navigate to the contest form and complete the required fields
3. Agree to these terms and conditions which include consent for a follow up call for a personalized quote for Pacific Blue Cross Guaranteed Acceptance Personal Health Insurance

*Note winner’s first name, last name and city of residence may be shared on Pacific Blue Cross website and social media platforms.

Anyone who carries out the steps described above and complies with these Contest Rules including but not limited to the eligibility requirements will be entered for a chance to win. All Contest entries must be received by the end of the Contest Period. Pacific Blue Cross is not responsible for and accepts no liability for late, lost, misdirected, delayed, or incomplete entries.

LIMIT ONE (1) ENTRY PER PERSON during the Contest Period. Any person who enters more than the allowable number of entries into the Contest and/or uses multiple names or identities will be disqualified by Pacific Blue Cross.

Prize

There is one (1) prize package available to be won.

The prize winner will receive $1,000 in health cash to be used towards the reimbursement of any items or services related to health and wellness. Reimbursement instructions will be provided to the winner.

Items or services do not have to be purchased together. Eligible items may include sports gear, wearable fitness devices, health and fitness classes, activity registration fees and spa services not already covered by a benefits plan or personal health insurance.

The prize is not transferable and must be accepted as awarded with no substitutions in cash or otherwise.

Winner selection

Pacific Blue Cross will hold a random prize draw at its office located at 4250 Canada Way, Burnaby, BC on or around May 1, 2023.

The chances of winning depend on the total number of eligible entries received.

Winner notification

Before being declared a winner, selected entrant will be contacted by phone or email and be required to (a) correctly answer a time-limited mathematical skill-testing question without mechanical or other assistance and (b) sign and return a Declaration, Consent, and Release form which confirms compliance with these Contest Rules, acknowledges acceptance of the prize as awarded, and releases Pacific Blue Cross, Twitter, Facebook and Run Vancouver Holdings ULC from any and all liability in connection with this Contest and the prize.

Pacific Blue Cross will make at least 3 attempts over the 10 days following the prize draw to contact the selected entrant. If the selected entrant cannot be contacted, fails to correctly answer the mathematical skill-testing question, fails to complete and return the Declaration, Consent, and Release form within 5 business days after being contacted, or cannot accept the prize for any reason, then at Pacific Blue Cross’s sole discretion, that selected entrant will be disqualified and another entrant will be selected by random draw from remaining eligible entries. Pacific Blue Cross is not responsible for the failure for any reason whatsoever, including its own negligence or due to computer, telephone, or technical problems, of a selected entrant to receive notification or for Pacific Blue Cross to receive a response from a selected entrant. In the event of a dispute regarding the identity of the entrant of an online entry, the entry will be deemed submitted by the holder of the associated email account.

Privacy

Pacific Blue Cross will use any personal information provided with the Contest entry and fulfilment, including the entrants’ name, address, postal code, phone number, and email address for the purpose of administering the Contest as contemplated by these Contest Rules.

By entering the Contest, you are providing consent for a follow up sales call from a Pacific Blue Cross sales agent up to 6 months following the contest close date. You can remove your personal information and opt out of receiving further correspondence from Pacific Blue Cross at any time by visiting pac.bluecross.ca/guaranteedacceptancecontest/home/optout. If you choose to remove your personal information and opt-out you will continue to be eligible for the prize.

Pacific Blue Cross collects and uses personal information in accordance with the provisions of the Personal Information Protection Act (British Columbia).

Limitation of liability

By entering the Contest, an entrant agrees to: (a) release and hold harmless PBC Heath Benefits Society (“Pacific Blue Cross”) and its subsidiaries, their respective directors, officer, employees, affiliates, suppliers, and agents  (collectively, the “Released Parties”)from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, any breach of these Contest Rules, or in any prize-related activity; (b) fully indemnify the Sponsors and its Partners and their respective directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all claims by third parties relating to the Contest, without limitation; (c) release and hold harmless promotional partners Meta Platforms Inc., Twitter Inc. and the Run Vancouver Holdings ULC from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, any breach of these Contest Rules, or in any prize-related activity.

The Sponsor assumes no responsibility for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet. Any attempt to deliberately damage or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Right to modify or terminate

Pacific Blue Cross reserves the right  to modify or cancel the Contest for any reason by publishing a notice on www.pac.bluecross.ca website if for any reason the Contest is not capable of running as planned, including technical failure or corruption, computer virus, tampering, unauthorized intervention, fraud or any other cause beyond the control of Pacific Blue Cross which in the opinion of Pacific Blue Cross affects the administration, security, fairness, integrity or proper conduct of this Contest.

General conditions

By entering the Contest, entrants accept and agree to be bound by these Contest Rules and the decisions of Pacific Blue Cross, which shall be final and legally binding. Pacific Blue Cross reserves the immediate right to disqualify any entrant which it deems, in its sole discretion, (a) is not in compliance with these Contest Rules, (b) tampers with the entry process, the Contest, or the website; or (c) is acting in an uncooperative, unsportsmanlike, disruptive, abusive, or threatening manner. No correspondence will be entered into by Pacific Blue Cross with respect to the Contest except with the selected entrant-. The Contest is subject to the laws of the Province of British Columbia and all applicable federal and municipal laws. The sole jurisdiction to resolve any disputes concerning this Contest is the Province of British Columbia.
